Terms of Service

1. Acceptance

By creating an account or using TrendingBrain, you agree to these Terms. If you do not agree, do not use the service.

2. Service Description

TrendingBrain is an AI-powered content generation platform that creates blog articles using artificial intelligence and live web research, and optionally publishes them to connected WordPress sites. The service is provided on a credit-based system.

3. Accounts

You must provide accurate information when creating an account. You are responsible for maintaining the security of your credentials and for all activity under your account. You must be at least 18 years old to use the service. One free article credit is provided per account. Creating multiple accounts to obtain additional free credits is prohibited.

4. Credits and Payment

Credits are purchased as one-time payments. There are no subscriptions or recurring charges. Credits do not expire. All purchases are final and non-refundable, except where required by applicable law. We reserve the right to change pricing at any time; changes will not affect previously purchased credits.

5. Content Ownership and Responsibility

You own the articles generated through your account. TrendingBrain does not claim ownership of content created for you. However, you are solely responsible for reviewing, editing, and verifying all generated content before publishing. You are responsible for all content published to your websites through the service, including any legal consequences arising from that content.

6. AI Content Disclaimer

Content is generated by artificial intelligence. While we strive for accuracy and originality, we do not guarantee that generated content is factually accurate, free from errors, free from copyright infringement, or suitable for any particular purpose. AI-generated content may contain inaccuracies, outdated information, or text similar to existing published works. You must independently verify all content before publishing. Citations sourced from the web should be verified for accuracy and relevance.

7. Prohibited Use

You may not use TrendingBrain to:

• Generate content that is illegal, defamatory, harassing, threatening, or infringes on the rights of others
• Create or distribute misleading health claims, unverified medical advice, or content that could endanger public safety
• Create medical, legal, or financial advice without appropriate professional review and disclaimers
• Generate content intended to deceive, defraud, or manipulate readers
• Publish content that violates advertising network policies (including Google AdSense) or affiliate program terms
• Impersonate individuals, organizations, or authoritative sources
• Distribute malware, phishing content, or spam
• Circumvent usage limits, security measures, or access controls
• Create multiple accounts to abuse free credits or promotions
• Reverse engineer, decompile, or extract the underlying AI models
• Use generated content to train competing AI systems
• Engage in any activity that disrupts or interferes with the service

8. WordPress Integration

TrendingBrain publishes content to WordPress sites you connect to your account. You are responsible for ensuring your WordPress site complies with all applicable laws, regulations, and third-party terms (including your hosting provider, ad networks, and affiliate programs). We are not responsible for how content performs on your site or any consequences of automated publishing.

9. Indemnification

You agree to indemnify and hold harmless TrendingBrain, its operators, and affiliates from any claims, damages, losses, or expenses (including legal fees) arising from: content you publish using the service; your violation of these Terms; your violation of any third-party rights, including intellectual property rights; or your use of the service in a manner not authorized by these Terms.

10. Limitation of Liability

TrendingBrain is provided "as is" and "as available" without warranties of any kind, express or implied. We do not guarantee search engine rankings, traffic, revenue, or any particular results from generated content. To the maximum extent permitted by law, our total liability for any claim arising from or related to the service is limited to the amount you paid us in the 12 months preceding the claim. We are not liable for any indirect, incidental, special, consequential, or punitive damages, including lost profits, data loss, or business interruption.

11. Account Suspension and Termination

We reserve the right to suspend or restrict your account at any time, with or without prior notice, for any reason we determine in our sole discretion, including but not limited to:

• Violation of these Terms or the Prohibited Use policy
• Publishing misleading, harmful, or deceptive content through the service
• Activity that poses a risk to other users, third parties, or the integrity of the service
• Suspected fraudulent, abusive, or unauthorized account activity
• Failure to comply with applicable laws or regulations
• Any other conduct we reasonably believe warrants account action

Upon suspension, your account will be locked and you will be unable to generate articles, purchase credits, or access dashboard features. A suspension reason will be provided. Your account data, including any remaining credits, will be retained but inaccessible for the duration of the suspension.

You may appeal a suspension by contacting support@trendingbrain.com. Appeals are reviewed at our discretion and we are not obligated to reinstate any account.

You may request deletion of your account at any time. Upon permanent termination, unused credits are forfeited and non-refundable. Sections 5, 6, 9, 10, and 12 survive termination.

12. Governing Law and Disputes

These Terms are governed by the laws of the jurisdiction in which TrendingBrain operates. Any disputes will be resolved through binding arbitration on an individual basis. You waive any right to participate in class action lawsuits or class-wide arbitration.

13. Changes

We may update these Terms. Material changes will be communicated via email or through the service. Continued use after changes constitutes acceptance of the updated Terms.
